Article 2 – Applicability

  1. These general terms and conditions apply to all offers, quotations, agreements and deliveries of Globalx, unless otherwise agreed in writing.

  2. By placing an order on the website, the customer agrees to these general terms and conditions.

  3. Deviations from the general terms and conditions are only valid if they have been agreed in writing by both parties.

Article 3 – Offer and Agreement

  1. The products and services offered on the website are described and displayed as accurately as possible. Obvious errors or mistakes do not bind the seller.

  2. An agreement is concluded when the customer places an order and this is confirmed by the seller by e-mail.

  3. Globalx reserves the right to refuse orders, for example if fraud or abuse is suspected.

Article 4 – Prices and Payment

  1. All prices listed are in [currency] and include VAT, unless otherwise stated.

  2. Any additional costs, such as shipping costs, will be stated separately during the ordering process.

  4. The customer is obliged to make the payment within the set term. In case of late payment, Globalx is entitled to terminate the agreement.

Article 5 – Delivery and Delivery Times

  1. Globalx strives to deliver the order within the indicated delivery period. Delivery periods are indicative and exceeding them does not entitle you to compensation.

  2. The products will be delivered to the address specified by the customer.

  3. If a product is no longer available, the customer will be notified as soon as possible and any payment will be refunded or an alternative offered.

  4. The risk of damage and/or loss of products lies with Globalx until the order has been delivered to the customer.

Article 6 – Right of withdrawal

  1. The customer has the right to cancel the agreement within 14 days after receipt of the products without giving any reason.

  2. To exercise the right of withdrawal, the customer must contact [email address] or complete a withdrawal form.

  3. The customer must return the products within 14 days after notification of withdrawal. The costs for return shipment are for the account of the customer, unless otherwise agreed.

  4. Globalx will refund the full purchase amount, including standard shipping costs, within 14 days of receiving the return shipment.

Exceptions to the right of withdrawal:

  • Products that are specially made to measure or personalized.

  • Hygiene-sensitive products whose seal has been broken.

Article 7 – Warranty and Complaints

  1. Globalx guarantees that the products comply with the agreement and the specifications stated in the offer.

  2. If the customer receives a product that is defective or damaged, this must be reported within 7 days of delivery via [email address].

  3. The warranty does not apply in the following cases:

    • Damage caused by intentional or incorrect use.

    • Normal wear and tear.

    • Damage caused by improper maintenance or use contrary to the instructions.

Article 8 – Liability

  1. Globalx is only liable for direct damage resulting from intent or gross negligence.

  2. Globalx is not liable for indirect damages, including consequential damages, lost profits or loss of data.

  3. Globalx's liability is in all cases limited to the amount paid by the customer for the product in question.

Article 9 – Force Majeure

  1. Globalx is not liable for delays or failure to fulfill obligations due to force majeure, such as natural disasters, strikes, pandemics, government measures or disruptions in transportation.

  2. In the event of force majeure, Globalx has the right to terminate the agreement or suspend delivery without being liable for damages.

Article 10 – Privacy and Data Processing

  1. Globalx processes personal data in accordance with the General Data Protection Regulation (GDPR).

  2. The customer can consult Globalx's privacy statement on the website for more information about the processing of personal data.

Article 11 – Intellectual Property

  1. All text, images, logos, and other content on the website are the property of Globalx or its licensors and may not be used without permission.

  2. It is not permitted to copy, distribute or otherwise use material from the website without written permission from Globalx.

Article 12 – Applicable Law and Disputes

  1. All agreements between Globalx and the customer are governed by Dutch law.

  2. Disputes are preferably resolved by mutual agreement. If this does not work, disputes can be submitted to the competent court in the district where Globalx is established.

Article 13 – Changes to the General Terms and Conditions

  1. Globalx reserves the right to change or supplement the general terms and conditions.

  2. Changes will be communicated via the website and will apply to future agreements.
